Terms of Service

These Terms of Service (“Terms”) govern your use of the CYPRONA PrivacyGuard AI platform (“Service”). By accessing or using the Service, you agree to these Terms.

1. The Service

CYPRONA provides automated website privacy and security compliance analysis using publicly available information. The Service does not constitute legal advice.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use CYPRONA.

3. Acceptable Use

  • No scanning of websites you do not own or control without authorization
  • No reverse engineering or abuse of system limits
  • No unlawful or malicious usage

4. Plans & Limitations

Free and paid plans include usage limitations. CYPRONA may enforce limits to protect platform integrity.

5. Seller Trust 360

Seller Trust 360 is an independent CYPRONA service for seller-controlled websites and related business assets. It is not affiliated with, endorsed by, sponsored by, or certified by Amazon. Amazon is a trademark of Amazon.com, Inc. or its affiliates.

  • You must own, operate, or have explicit permission to assess every submitted website and asset.
  • You must not upload passwords, one-time verification codes, customer databases, payment-card information, banking credentials, secret API keys, or unnecessary identity documents.
  • Scores, findings, AI summaries, badges, and reports are readiness intelligence, not legal advice, legal certification, a penetration test, Amazon approval, or a guarantee of sales, rankings, account standing, or prevention of marketplace action.
  • Paid assessment work begins after payment confirmation. Annual monitoring renews yearly until cancelled under the displayed billing terms.
  • Automated results may require human review. CYPRONA may withhold, correct, suspend, or revoke a report or badge when evidence is incomplete, inaccurate, expired, or materially changed.

6. Customer Content and Uploaded Documents

You retain ownership of information and documents you submit. You grant CYPRONA a limited right to store, process, analyze, and reproduce that content only as needed to provide, secure, support, and improve the requested Service. You are responsible for ensuring that your submission is lawful and does not include unnecessary personal information or confidential information you are not authorized to share.

7. Intellectual Property

All platform content, reports, trademarks, and AI outputs remain the intellectual property of CYPRONA.

8. Disclaimer

The Service is provided “as-is”. CYPRONA does not guarantee regulatory approval or compliance outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, CYPRONA shall not be liable for indirect, incidental, or consequential damages.

10. Governing Law

These Terms are governed by the laws of the Province of Alberta and the laws of Canada.

Cookie Policy (CASL-Aligned)

CYPRONA uses limited cookies and similar technologies to operate securely and efficiently.

1. Types of Cookies

  • Essential Cookies – required for platform functionality
  • Security Cookies – fraud prevention and abuse detection
  • Analytics Cookies – aggregated, anonymized usage insights

2. Consent

Where required by CASL, consent is obtained before non-essential cookies are set.

3. No Advertising Cookies

CYPRONA does not use third-party advertising or behavioral tracking cookies.

4. Managing Cookies

You can control cookies through browser settings. Disabling essential cookies may impact functionality.

Data Processing Addendum (DPA)

This Data Processing Addendum applies to business customers (“Controller”) using CYPRONA (“Processor”).

1. Scope

CYPRONA processes personal data solely to provide the Service as instructed by the Controller.

2. Processing Details

  • Purpose: Compliance analysis and reporting
  • Data Types: URLs, metadata, account identifiers
  • Duration: For the term of service + legal retention

3. Processor Obligations

  • Process data only on documented instructions
  • Maintain appropriate security safeguards
  • Ensure confidentiality of personnel

4. Sub-processors

CYPRONA may engage trusted infrastructure providers subject to equivalent data protection obligations.

5. Data Breach Notification

CYPRONA will notify Controllers without undue delay upon confirmation of a data breach.

6. Data Subject Rights

CYPRONA assists Controllers in responding to access, correction, and deletion requests.

7. Data Deletion

Upon termination, personal data will be securely deleted or anonymized unless legally required to retain it.

10. Governing Law

This DPA is governed by Canadian law, including PIPEDA.
